Bus Ticket on July 10, 2003 I was informed by Mathew Rodewald the Vs. President of the St.Paul Evangelistic Food Ministry that a tow truck and a cop was out by my Campaign Bus and it looks like they are taking it.
I and Sharon Anderson went out to see what was going on.
First the West Saint Paul Police Officer said that it was parked over 36 hrs. and I told him I just drove it last night and then he said that it was abandoned, I told him "how" could it be abandoned if I am standing here?
Then I told him that it was My Campaign Bus, then the West Saint Paul Policemen said that it was not a campaign bus. and BUDGET TOWING took it away Lothenbach St., close to Oakdale St. intersection

This same Campaign Governor Tim Pawlenty was on in the fall of 2002 as I ran for Minnesota Governor's Race.
In about Nov. of 2002 Mark Dayton paid $500.00 for 6 used tires after they were flattened at the curb by a Union Hall, across the street from KSTP CH. 5 and was taken to the impound lot where it was about to be sold or scraped in 2 days, but Mark Dayton saved it by getting the tires and my bus was released without any towing fee or storage fee.

But like I said about my 1988 mobile home bus being stolen before my eyes.
I was never compensated for this Theft. I feel I have a claim against Defendants Police Chief Bud Shaver, City West St.Paul and Sheriff Fletcher and Met Council.
I was arrested and held without bail or charges in St.Paul while protesting legally, by the Ramsey County Sheriff's Deputies under Sheriff Bob Fletcher and was not given my med's for Epilepsy 500 mg. DILANTIN daily, and when I demanded them they roughed me up and shackled me while one deputy was standing on my caves, and then they dragged me down to a different cell that had blood all over the walls and floor and thrown me in on the floor.

Crow Wing County Voter Fraud

This 17-minute video documents a case of potential voter fraud that occurred in Crow Wing County. On Friday, October 29th, 2010, a member of the Minnesota Freedom Council witnessed apparent voter fraud occurring at the Crow Wing County Courthouse in Brainerd, Minnesota. Upwards of 100 residents from a local group home for mentally disadvantaged individuals were brought into the County Courthouse to cast absentee ballots. The witness reported that supervisors were telling voters to cast a straight Democrat ticket. There was even a report of a voter prematurely leaving the voting both and a supervisor casting the ballot for the voter. Essentially, the people in-charge were taking advantage of the mentally disabled in order to bolster the vote for their candidates of choice. These individuals involved can be charged with a felony under Minnesota election laws. Formal complaints are in the process of being filed with the Crow Wing County Attorney.

Why are you seeking the office of Attorney General?

There is a current crisis in the legal system and the Attorney General should be in the front line keeping the legal system just for the average person. As a working man I can empathize and understand the needs of the average citizen and make sure the Office of the Attorney General shows equal care and empathy. Enough is enough when it comes to the injustices of the past 30 years.

Top three policy issues:

1. Stop Minnesota Corporations from taking advantage of illegal immigrants for cheap labor. This encourages illegal immigration. We need to encourage fair labor practices that cause the level of pay for all workers to improve internationally so that out sourcing and cheap foreign labor are not an incentive to cause Minnesotans to loose their jobs.

2. Stop fraud and illegal practices by corporations and government that harm the ordinary citizen.

3. Prosecute fraud, misconduct and other criminal conduct by public official and corporations.

Role as consumer protection advocate:

The Office of the Attorney General must protect the public safety and welfare, and additionally protect the public from corruption and fraud by government officials and bureaucracy.

Further there must be a focus on prosecuting crimes that are covered up by local city and county attorneys to keep these local officials accountable.

Priorities of responsibility to state governments, local governments and individuals:

The first and foremost responsibility is to the individual citizens of Minnesota.

City and County governments are subdivisions of the state government, however, these entities, often corporations, should not receive special protection and should not receive legal representation in cases where there is questionable conduct, discrimination, prejudice, abuse of power, or other similar abuse of public office, by any state and local officials. These entities and persons should be responsible for paying for and obtaining their own legal counsel.

Crunch Time on Health Care Bill

Democrat leaders have promised to force the health care bill through Congress in a matter of days, suggesting use of the so-called “nuclear option.” That trick, technically called budget reconciliation would enable the Senate to pass a House-amended version of its own already-approved health care bill, bypassing debate and thus staving off any filibuster. There’s some doubt about using reconciliation in this manner, and it’s even possible that it won’t be utilized at all. The waters around the health care reform process in Washington are murky.

Senator Byrd has said, “Using reconciliation to ram through complicated, far-reaching legislation is an abuse of the budget process. The writers of the Budget Act, and I am one, never intended for its reconciliation’s expedited procedures to be used this way. These procedures were narrowly tailored for deficit reduction. They were never intended to be used to pass tax cuts, or to create new Federal regimes.”

Vice President Joe Biden once characterized the “nuclear option” as an “example of the arrogance of power,” and President Obama said such a move “would change the character of the Senate forever.” But that was 2005. Now that every major poll shows overwhelming opposition to the health care reform bill being put forth by the Democrat-controlled Congress, and Republicans have swept recent special elections chiefly because of the bill, Congressional leaders are willing to resort to tricks they themselves called “dirty” to get their way.

All 41 Republican senators have pledged to object to reconciliation being used in the manner proposed and Senate rules require 60 votes to waive the Byrd rule, which would squash attempts to use budget reconciliation for non-budget-related policy changes.

Reconciliation is just one dirty aspect of the process being used to force health care reform. The current senate bill has a House number: HR3590, but it isn’t the House health care bill. That’s HR3200. Bills that originate in the senate have a number beginning with “S,” such as S2431. There’s a reason for this anomaly. Bills that raise revenue must, according to the Constitution, originate in the House. Senator Reid wanted to pass his own version of health care reform in the senate, though, so he hijacked an unrelated bill that the House had already passed. It was HR3590, a 6-page bill to provide tax breaks to members of the military who were buying a house. Senator Reid offered a “delete all” amendment to the bill, stripping out all of the original language and intent of the house bill and inserted the over 2,500 pages of his tax-raising health care plan. Thus, he obtained a House bill number for his Senate-originated, revenue-raising health care bill by essentially ripping the cover off of a legal bill and stapling it on to an unconstitutional bill.

Pushers of the health care takeover are well aware that a supermajority of the American people are opposed to their plan, so they’ve been using every backroom dirty trick in the book and inventing some new ones to try to force this legislation against the will of the people. Payoffs, threats, smearing and ousting troublesome representatives are just some of the underhanded tactics involved. They know the votes they’ve coerced and cajoled won’t survive an Easter recess, when members of Congress will return to home districts and face their constituents, so they are desperate to pass the bill before the recess.

Now is the time to be heard. It may rain (40% chance), but we are all needed at the Capitol on Saturday. This is our last chance to remind our forgetful representatives that we don’t want the Reid/Pelosi/Obama health care plan. If it does rain, all the better if we still turn out for an hour in strong numbers. That would be a true demonstration to Minnesota’s congressional delegation of our unwavering conviction in opposing the health care takeover.

Pawlenty Set to Sign, but Reduce $1 Billion Bonding Bill

After an initial veto threat sent the House and Senate approved bonding bill into legislative limbo, the Governor met with Democrat leaders and began negotiations. A deal was eventually struck. The sticking point appeared to be funding the governor wants for expansions to the Moose Lake sex offender treatment facility. The legislature left that out of the bill they passed, prompting the governor’s veto threat. The bill has been referred back to a conference committee, where, the governor’s demands are being met in part, in order to stave off a veto of the entire bill. Pawlenty will likely instead use the line item veto authority to trim the bonding bill down to around $750 million, leaving in his pet projects. $47.5 million has been approved for the Moose Lake facility. House Government Operations Committee Passes Election Reform Bill

Election Administration Bill is an Example of the Art of the Possible HF3108 is an elections administration bill aimed at strengthening the integrity of Minnesota’s election system, mostly through “back end” administrative procedures. The bill will require new verifications to be performed on voter registration records, including checks against the Social Security Administration’s lists of deceased individuals and Department of Corrections data on felony convictions. It also strengthens and better defines a required check of voter records against Department of Public Safety data to ensure non-citizens are not allowed to register to vote. The bill was approved by the House Government Operations Commitee on Thursday, March 4th. The bill will also establish new reporting requirements, so that the legislature will be regularly informed of the state of the election system and anomalies that may arise. For example, when a new voter registers, a Postal Verification Card is mailed to the voter’s registered address. If the post card is returned as undeliverable, that voter will be flagged for challenge at the next election, but lists or even counts of returned PVC cards are not routinely revealed. HF3108 will require a biennial report of returned PVC cards to the legislature. This will provide insight into how many new registrations can not be verified. The bill also cleans up some unusual data handling procedures that previously muddied the waters of the Statewide Voter Registration System, making it difficult to forensically determine exactly who voted in past elections. Toward the ends of transparency and integrity, this bill represents a good first step. More reforms will still be needed (especially a photo ID requirement), but in the committee hearing in which the bill was approved, Representative Kiffmeyer, a Republican co-author of the bill observed that politics is the art of the possible. This bill’s chief author was Representative Winkler, a Democrat and it was the product of bipartisan meetings on election issues. This is what was possible at the time. Though Several election officials attended the committee hearing, such as Ramsey County Elections Director, Joe Mansky and The Head of Elections for the secretary of state’s office, Michelle Desjardin, none testified for or against the bill. Minnesota Majority testified in favor of the bill. The bill was passed out of the House State and Local Government Operations Reform, Technology and Elections Committee on an overwhelming voice vote. There were one or muttered two “no” votes. The bill must still be approved by the whole House and by the Senate. Gerlach's bill will have a hearing in the Senate Government Operations and Oversight Comittee on Monday, March 8th at 3:00 PM, Room 123 State Capitol.

Congress Prepares to Go Nuclear on Health Care

On Wednesday, President Obama held a press conference in which he arrogantly declared that the time for debate is over on health care 'reform'. The president surrounded himself with people in white lab coats in an attempt to legitimize his message. But in reality, it was difficult to keep track of the number of false and misleading statements the president made over the course of his speech.

One fact was made crystal clear: Democrats plan to go it alone without Republican support. Now that they no longer have a 60-vote majority in the Senate, they plan to change the rules of the game and employ a parliamentary trick known as "reconciliation" or the “nuclear option.” Usually reserved for budget bills, the maneuver would allow the Senate to pass this massive bill with only 51 votes instead of the normal 60-vote super-majority required for all major legislation. This trick would require the House to pass and amend the Senate version of the health care bill, with an understanding in the senate that the House can get what it wants in the conference committee. After the conference committee, the newly re-minted bill would be submitted back to the House and Senate for a final vote. Passage would require a simple majority in each body.

President Barack Obama, Vice President Joe Biden, Senator Schumer, Senator Reid, Senator Feinstein, and other Democrats claimed bypassing the 60-vote filibuster rule in the Senate would tear down the fabric of the republic and change the Senate forever. They said the suggestion by Republicans in 2005 to change the rules to stop Democrat filibustering of presidential nominees was a naked, arrogant power grab and un-American. Now that they can’t get their way playing by the rules, the “nuclear option” is seen as their noble duty. See here for a video compilation of Democrats protesting the “nuclear option” in 2005.

Every major poll shows that the American people oppose ObamaCare and want Congress to start from scratch. But President Obama and his colleagues in Congress don't appear to be getting the message.

Election Changes on the Horizon

Three prominent elections bills are moving through the state legislature. The first bill, SF2251 will move the primary to August to allow more time for military absentee ballots to be processed. In 2008, nearly 10% of absentee ballots cast by military members serving overseas were rejected because they arrived too late to be counted. Moving the primary from September to August should provide the time needed to compensate for that travesty. The bill isn’t controversial and has already passed the House and Senate by huge margins. Only 5 representatives voted against it and it was unanimous in the Senate. The Senate bill had minor differences with the house version, that look to have been resolved by an amendment in the House. The bill will probably be presented to the governor’s office today. All indications are that he will sign it into law. The Primary election will henceforth be held on the second Tuesday in August. The second bill was passed out of the House government operations committee today by a unanimous vote. SF2622 / HF3111 is also relatively non-controversial. It codifies changes in the way absentee ballots will be handled and counted, establishing ballot boards to help ensure absentee ballots aren’t improperly rejected. The bill is likely to pass without much clamor and will likely be signed by the governor. The third bill has it’s first hearing in the House government operations committee on Thursday at 8:30 AM. SF2388 / HF3108 could produce a couple squabbles. It’s an elections administration bill that toughens up requirements for voter list maintenance and verifications, and requires biannual reports to the legislature on critical election statistics, like the number of postal verification cards returned undeliverable after an election or random sampling of registered voters. The bill also expands the scope of resources the secretary of state is mandated to utilize to verify voter records, including the federal Social Security Administration’s database of deceased people. It also provides for new checks against data maintained by the Departments of Corrections and Public Safety to flag ineligible felons and non-citizens who may have become registered to vote. Another important aspect of this elections bill is that it codifies in law certain ballot reconciliation requirements to assure that all ballots are properly accounted for. Election judges will be required to count the ballots contained in a package when they are opened to verify that the count is correct (there are typically supposed to be 50 ballots in a package, but they are often not precise). Then, when the polls close, election judges will be required to account for every ballot received in the morning, reconciling with ballots cast, spoiled, duplicated and unused so all ballots at the end of the day tie out to the number of ballots received in the morning. Minnesota Majority sued the Secretary of State’s office over the issue of reconciliation because following the 2008 election, it was found that as many as 40,000 ballots that were counted could not be accounted for in the Statewide Voter Registration System. In other words, there weren’t enough voter histories indicating people who voted in 2008 to account for all the ballots. Examining precinct-level original election documents and manually counting signatures on roster pages and absentee ballots in three Ramsey County precincts revealed that the canvassing board somehow counted more ballots in all three examined precincts than there were voters who signed in. This issue appears to be widespread. There are over 4,000 precincts in Minnesota, so it should be apparent why this reconciliation process is so important. Under former Secretary of State Mary Kiffmeyer, an administrative rule was in place to ensure this reconciliation. Now Representative Kiffmeyer, a co-author of the elections administration bill claims that the first thing Secretary Mark Ritchie did on assuming office was to dismantle that reconciliation process. He claimed the counties did not like it because it was too much work, to which Representative Kiffmeyer responded, “before optical scanners, election judges used to have to hand-count every ballot, and often wouldn’t be out of the polling place until after three in the morning. Doing these checks isn’t so much work and it’s vital to ensuring the integrity of our elections.” Representative Kiffmeyer makes a good point, but it’s still likely that Secretary of State Mark Ritchie will lobby and testify against this provision of the bill. UPDATE: HF3108, the election administration bill passed the House Government Operations Committee on Thursday, March 4th. A good first step toward improving confidence in our elections. Democrats Mount GAMC Veto Override Attempt – Fails in House

Following the governor’s veto of a bill to restore $170 million in funding to the essentially defunct General Assistance Medical Care program, Democrats in the Senate voted to override. No Republicans joined in the vote. The override attempt in the House was not successful. A 2/3 vote in the House was needed, which would have required 3 Republicans to vote for the override. None did so. The effort failed by a party-line vote of 86-47. GAMC funding is slated to run out in April, when the governor plans to move all enrollees to the less generous Minnesota Care program. Minnesota Care is more similar to the traditional private health care plans most Minnesotans utilize and costs the state’s taxpayers far less per enrollee. GAMC directly paid for 100% of all medical and dental care for the enrollee with unlimited coverage. The cost of the program has been skyrocketing, growing by 36% annually and it was clearly unsustainable. The governor did the right thing for the state of Minnesota by vetoing the attempt to resurrect the bankrupt program. To be sure, beneficiaries of the extraordinarily generous program will protest the loss of their entitlement, but the approximately 30,000 enrollees aren’t being left high and dry by any stretch. Minnesota Care will provide them the same level of insurance coverage any privately insured worker has access to. The demise of GAMC will mean one less bureaucracy for the state to maintain, and save the state money in direct payments and administration. Three additional medical assistance programs still remain. One could hope that they will eventually all be merged into one cost-effective program for even greater efficiency later. State Reps Speak-Out on Boondoggle Bonding Bill

Four Minnesota state reps today weighed-in on the $1 billion bonding bill. The bill was kept alive when by a legislative trick on the part of Speaker Margaret Kelliher which prevented it from going to the governor's desk. Governor Pawlenty, who earlier this week promised to veto the bill, now appears to have agreed to engage in further negotiations with DFL leaders on the bill. It is irresponsible for lawmakers to add another $1 billion of debt to Minnesota's balance sheet at a time when we cannot make the payments on our existing debt. Minnesota Majority is urging Governor Pawlenty to demonstrate fiscal responsibility by keeping his commitment to veto the bonding bill in its entirety. TAKE ACTION: Call Governor Pawlenty at 877-37-VETO-IT and urge him to keep his promise to veto the bonding bill in its entirety.

On Bonding Bill, Some State Legislators Repent

Some Representatives and Senators Change Bonding Bill Vote – Despite Veto Threat, Bonding Bill Not Dead Yet The governor has announced that he will veto the bonding bill in it’s entirety, but House Speaker Kelliher may have one last trick up her sleeve. She said she intends to send the bill back to the Senate for “further consideration.” This is simply a stalling tactic to buy time to pressure the governor into negotiations. After a conference committee reached agreement on the $1 billion bonding bill, reconciling minor differences between the House and Senate versions, the House took up the final bill for a vote after 7:30 last night, passing it 85-46. Eight Republicans who’d voted to pass the initial bill withdrew their support. Republican Representatives Bud Nornes (10A), Paul Anderson (13A), Greg Davids (31B), Jim Abeler (48B), Tony Cornish (24B), Tom Hackbarth (48A), Mary Liz Holberg (36A) and Torrey Westrom (11A) changed their votes on the bonding bill to no. Democrats Bill Hilty (8A) and Al Juhnke (13B) also had a change of heart, withdrawing their support for the bill. Representative Paul Kohls (34A) was home recovering from a concussion when the bonding bill first passed. When he returned to work, he added another "no" vote to repassage of the bonding bill. The Senate took up the amended bill after 9:00 PM and also passed it, but again, some Republicans changed their votes from yes to no. The final vote in the Senate was 47-19. Republican senators Bill Ingebrigtsen (11), Joe Gimse (13), Gen Olson (33), Pat Pariseau (36), Mike Jungbbauer (48), and Julie Rosen (24) changed their votes from yes to no. Democrat Tony Lourey (8) also changed his vote to no. It looks like the bonding bill debate isn’t over yet. How long Speaker Kelliher can keep the bonding bill from the governor’s awaiting veto pen is uncertain. The best case scenario for the taxpayers is no bonding bill at all, but Governor Pawlenty has indicated willingness to sign a bonding bill in the $750 million-range if it includes certain items he considers priorities, like the Moose Lake Sex Offender facility and Vermillion State Park. If legislators rework the bill toward those ends, the governor may still approve more borrowing this session. Minnesota Majority rejects the idea of any further borrowing until the deficit is solved. Until then, there isn't even money to service the debt we now have. No sane person would take a maxed out credit card they already can't afford the payments on and ask for an increase in the credit limit to borrow more. Why would we allow our state government to do so? In addition, when the deficit is solved, any bonding should only be for genuine, necessary public purpose projects. Update: Senator John Doll had been erroneously listed as having voted "yes" on repassage. Minnesota Can't Afford Current Debt Payments, but Will Borrow Another $1 Billion

Both the Minnesota House and the Senate have passed similar versions of a bonding bill equaling about $1 billion in general obligation bonding. In the House, Speaker Kelliher pushed the bill through without allowing debate.

Right now, minor differences between the two bills are being reconciled in a conference committee.

Minnesota is already in debt over $7 billion. Making the payments on that borrowed money consumes over 3% of the state’s biennial budget, and we’re running a deficit of over $1.2 billion this year, with deficits projected to be over $5.4 billion in the next biennium. This means we can’t afford to make the debt payments we are already obligated to make. Taking on more debt in a financial crisis like this, one might think the money must be for something pretty important. Some of the money is for worthy projects like improvements to public facilities, but these improvements can wait and there is absolutely no excuse for some of the appropriations. Legislators in the conference committee have decided a criminal sex offender facility in Moose Lake isn’t important enough to borrow money for this year, but they will use the taxpayer’s maxed-out credit card for:

The Perpich Center for the Arts ($1.2 million)
The Minnesota Zoo ($32.5 million)
Amateur sports ($4 million)
The Metropolitan Council ($74.5 million)
The Minnesota Historical Society ($14 million)
New hiking and ATV trails connections ($31 million)
Expanding a campground facility ($1 million)

This bill will probably emerge from conference committee today. The governor will have three days to veto or sign the bill.

Metro Gang Strike Force members committed crimes by taking home property that had been seized during their police operations, the co-chair of a state panel that investigated the unit said Thursday.
Some 10 or 12 Strike Force members in the 34-member unit were implicated in the misconduct, and the information has been given to the FBI, which is conducting its own investigation, said Andy Luger, a former assistant U.S. attorney, who headed the panel with retired FBI agent John Egelhof.
The state inquiry into the disbanded Strike Force uncovered "substantial evidence of misconduct" that went well beyond revelations previously reported by news media or uncovered in earlier government investigations.
The panel's report, issued Thursday, said that Strike Force employees repeatedly took home seized property for personal use and that many of the seizures themselves were improper. Luger said he wouldn't name the accused officers because of the ongoing FBI investigation.
"It's going to be for the FBI and the United States attorney's office to determine, but when you take something home that doesn't belong to you, and you know it doesn't belong to you, it's a crime," he said.
The property included flat- and large-screen TVs, laptops and other computer equipment, electronics and recreational items such as water scooters.
Luger said that while "properly conducted, aggressive investigations can save lives," force officers "engaged in serious misconduct -- misconduct that was appalling and outrageous." The report said much of the force's activity had little to do with gang investigations.
State Public Safety Commissioner Michael Campion said that he was "disappointed, disturbed and troubled by the findings" and that his department will no longer fund crime task forces set up like the Strike Force.
He said he'd follow the panel's recommendation to appoint a Special Master to try to identify victims of the illegal tactics and return improperly seized money and property to their owners. About $1 million in seized funds is in Strike Force accounts.
Campion said he also plans, at the recommendation of the panel, to meet with law enforcement officials and prosecutors to create a new approach to investigating gangs across jurisdictional lines.
A state House and Senate legislative hearing on the Strike Force was expected to convene Wednesday.
Almost everyone the Strike Force stopped while saturating neighborhoods were minority group members, and officers seized their property and money even though they often were not gang members and officers didn't intend to try to get them prosecuted, the report said.
"Something went terribly wrong at the Metro Gang Strike Force, and it should not be allowed to happen again," the report said. It urged that any future strike force be tethered to a law enforcement agency, and if not, that prosecutors either run the unit or oversee the investigations.
The report praised the "hard and thorough work" of some force members but said others engaged in "unethical and highly questionable conduct."
The panel reviewed about 300 cases opened from 2006 to 2009, said Luger. Some property officers removed from the evidence room had been stolen by criminals and could have been returned to owners, the report said. One witness called the taking of property a "free-for-all."
Repeatedly, officers or their families paid nominal amounts to take items from the evidence room, including water scooters and a trailer, the report said.
Lots of property still missing
Campion created the panel in May after a critical report on the force by the Minnesota Legislative Auditor. Hours after that report was issued, force members were found shredding documents at the force's New Brighton offices, and officials suspended force operations. Campion permanently shut it down in July.

The report said that a lot of property that should still be in the evidence room was missing. Other seized things, including narcotics, never were entered into evidence but were found in the Strike Force offices, the report said.
The report told how a seized ice-fishing auger went missing. After the case was over, the owner wanted his auger back, but an officer had taken it home. "The officer in charge of the case threatened to obtain a search warrant [for] the home of the officer who took the auger," the report said. The auger was then anonymously returned to the force offices. The force returned the auger to the owner, saying it was 'slightly used,''' Luger said.
In another case, 20 watches potentially worth $2,000 were missing, and the case file contained a false statement that they were given to a jeweler for sale, the report said.
The report said the officers searched people's cell phones without warrants, photographed people -- including children -- who had no gang connections, and took property without search warrants.
Luger noted many gangs are ethnically based, and he declined to describe what the force did as racial profiling.
The panel said $10,781 in seized cash was missing, down from $18,000 noted by the Legislative Auditor in May.
Files included signed statements that evidence had been destroyed, when in fact it hadn't been, the report said.
Documents shredded in May were connected to numerous cases, according to the report. Officials that day found case files behind the headquarters in trash bins that were accessible to the public.
Self-professed 'money police'
Many files the panel examined lacked fundamental information about the cases, and other case files were simply empty, the report said.
Some officers referred to themselves as "money police," displaying conduct that would be "unthinkable" in their home agencies, the report said.
The panel found that the unit relied too heavily on forfeitures for revenue and said that forfeiture laws may need overhaul to prevent abuses. The panel also said the force lacked adequate external oversight, fostering a mentality that officers could do what they wanted.
Without supervision, much of the activity focused on minor drug enforcement. The report described cases where thousands of dollars were taken from people who were not drug dealers but possessed small amounts of marijuana.
The report said the unit lacked procedures and training to assure officers would resist the "temptation" to take items.
The Public Safety Department budgeted $110,000 for the three-month investigation, and has spent $90,000 so far, all on compensation for Luger and Egelhof, said spokesman Andy Skoogman.
Manila Shaver, West St. Paul police chief and chair of the force's advisory board, said it was premature to comment until the FBI finishes its probe.
Hennepin County Sheriff Rich Stanek said he'd been concerned about the force's evidence handling for months and backed the investigations. He said the FBI probe "needs to continue aggressively, and those responsible for this egregious misconduct leading to criminal activity should be prosecuted to the fullest extent of the law."
Minneapolis police Sgt. Jeff Jindra, a Strike Force supervisor, said the report was "just like a kick in the stomach'' because it taints all the officers' good work.
He disputed the findings of missing evidence, saying if investigators had talked to him he would have said that when a Minneapolis officer on the force seized something, it was put in the Minneapolis police property room and noted in a file at Strike Force headquarters. Seized cash went to the Strike Force property room, he said.
Said Luger: "The incomplete case files did not involve solely Minneapolis police ... cases. During our investigation, we requested from a number of police forces any Strike Force-related files ... We received some information from Minneapolis. It does not change our findings."

I bet the state and or the city will not be re-imbursing the folks who have lost these items. The citizen can be penalized by the state and they dang better cough up or property will be siezed or one will be jailed. But let the state/government mess up and its........"oh well, we were just doing our job!"

Finally Validated
For those of us who grew up in MPLS and watched ourselves or friends be victimized by police, we have finally been validated in all that we have seen and been subject too. Police (including black officers) are targeting minorities. Some people say that the theft/misuse of powere is ok because they are gang bangers but the fact is they are targeted and the police sought to gain from targeting them. How am I to explain to my nieces and nephews that all crimes are treated the same, that all criminals are treated the same when obviously they are not. There are plenty of affluent/business people who do cocaine every day but because they aren't driving flashy cars or live in poorer neighborhoods, that makes their crime ok?? The city of MPLS needs to prosecute these officers, because it's the law and also out of respect for the officers who do work hard and the citizens who had paid there salaries.

I had a friend that was a passenger in a car with someone who was pulled over for a dui. The driver was arrested and the officers made him give all his money to them and made him and then said "walk home". They left him on 394 with no money after robbing him. Cops can do anything they want. These strike force guys belong in the clink with the druggies, but in this country, they will probably get medals of valor for robbing and stealing.

Interim gang strike force out of business

The state's public safety commissioner pulls plug five days after its creation

Minnesota's top cop shut down the interim Metro Gang Strike Force on its fifth day of operation Friday — before the new officers hit the streets — and said he doesn't see a way for it to exist in the near future.

But the law enforcement agencies that make up the task force might want to set their own course. Advisory board chairman Bud Shaver sent word Friday that he was calling a special meeting July 29 and the new investigators were being told to "stand down" until the board reached "some type of resolution," according to an e-mail he sent to board members.

Public Safety Commissioner Michael Campion's announcement followed news Thursday that the commander of the interim unit was leaving his post. It wasn't the final straw, but "that's one of them," Campion said.

He said his primary rationale for shutting down the interim unit was a lack of "a common mission statement" among participating agencies. There were barely enough officers for it be operational and not enough interest from departments in the west metro, he said.

Earlier Friday, Hennepin County Sheriff Rich Stanek said he was removing his employee, Capt. Chris Omodt, as the gang unit's commander because "the gang strike force unit has completely lost all of its credibility."

He also said he doesn't "believe that this Metro Gang Strike Force can ever get back on track in its current form, operation, environment."

The unit has been under fire for months; an Finternal inquiry are under way.

On May 20, the legislative auditor issued a report that said the unit had mishandled seized cash and cars. Hours after its release, officers reportedly shredded documents at the unit's office in New Brighton.

A smaller, interim Metro Gang Strike Force was formed after Campion indefinitely suspended the original unit in June.

This week, allegations surfaced that Shaver, the West St. Paul police chief and gang strike force advisory board chairman, asked in January that — as a favor to him — a St. Paul police officer arrest a convicted sex offender to get the man out of Shaver's daughter's life, according to a police report. The officer relayed the request to a Gang Strike Force member.

his daughter — who was suspected of being involved in drugs and with the convicted sex offender in a car registered to Shaver — that officers not forfeit his vehicle, a police report said.

Shaver said Thursday he wouldn't have used his position to influence another officer, hadn't asked anyone not to forfeit his car and thought he had done nothing improper in the case.

Campion said he didn't have all the facts, but from what he's heard, Shaver may have used "some bad judgment."

Omodt took over the strike force Jan. 20 and didn't know about the Shaver case until recently.

Shaver gave Omodt day-to-day direction, Stanek said. The lack of information about what happened in the Shaver case "weighed into my decision to recall Capt. Omodt and our participation in Metro Gang," Stanek said after a news conference.

Stanek said a "sequence of events" led to his decision, which revolved around "ethics and integrity in law enforcement."

Omodt had been brought in to "reform the gang strike force," and the matters under review by the FBI didn't happen when Omodt was part of the unit, Stanek said.

"It's been tremendously frustrating in recent months that I have not been able to do the important work of fighting gangs," Omodt said. "I firmly believe that combating gangs requires a coordinated effort on behalf of law enforcement and that law enforcement must have the public trust to be successful."

Stanek said he has been meeting with the 37 police chiefs in Hennepin County to determine how best to continue fighting gangs.

The St. Paul Police Department, which has its own gang unit, will remuster its resources to address gangs, said Sgt. Paul Schnell, police spokesman.

"There is a continued belief that a metro-wide entity of some form can be very effective and beneficial, but the department supports and respects the commissioner's decision and commits to participation in the future," Schnell said.

Police Chief John Harrington, who was out of town Friday, plans to continue being part of discussions about the future of gang fighting, Schnell said.

The Dakota County sheriff's office had one deputy working on the interim unit, and Chief Deputy David Bellows said the unit should regroup.

"We still feel strongly that a specific unit dealing with gang-related crimes is essential," he said.

Maplewood Police Chief Dave Thomalla, who had one officer assigned to the interim gang unit, said he's "hoping in the coming weeks that enough people can put their heads together to come up with a new alternative plan."

He said they might then make a proposal to the state Department of Public Safety for the funding that had been directed to the Metro Gang Strike Force.

The Legislature created the Minnesota Gang Strike Force in 1997; it was reorganized into the Metro Gang Strike Force in 2005 after new legislation. The law specifically directs that there be a Metro Gang Strike Force.

Campion was asked by a reporter Friday whether he had authority to shut down the unit. "I think we're probably out there a little bit. We wouldn't have done it if we didn't think we had the authority," he said.

State law doesn't specifically say the public safety commissioner controls the unit, Campion said, but he does control its funding. Participating departments have joint-powers agreements.

Campion said he or Department of Public Safety employees had talked to key legislators and the governor's office about his decision.

Rep. Michael Paymar, DFL-St. Paul, chairman of a House public safety subcommittee, said he agreed Campion had legal authority to scrap the strike force if it wasn't working.

He said he was troubled by the revelations of problems with the strike force.

The concept of the strike force was good, he said, "but the mission always was a little bit foggy." If public safety officials revive it, "we would need a whole new model," he said.

But he said he wants to wait until the FBI completes its investigation "before taking the next step."
